Font License Agreement

This Font License Agreement (the "License") is a legal agreement between you and Forest Techno, LLC ("Forest Techno", "we", "us"), the company that operates WonderFonT at wonderfont.art. It sets out what you may and may not do with the fonts you license from WonderFonT. You accept this License when you click to pay under the notice that says so, and by downloading, installing, embedding or otherwise using any WonderFonT font. If you do not accept it, do not buy or use the fonts.

This License works together with our Terms of Service, our Refund Policy and our Privacy Policy. If this License and the Terms of Service disagree about how you may use a font, this License wins.

1. Short version

This summary is for convenience only. The full text below is what binds.

WonderFonT sells three licenses: a Desktop License for one family, a Web License for one family, and a Web Library Subscription for every family.
Desktop License: one payment, yours to keep. You get the desktop files, and everyone in your business may use them. It does not cover live text on websites.
Web License: one payment, yours to keep, for 1, 5 or 25 registered websites. The fonts are served by WonderFonT. There are no files to download.
Web Library Subscription: every published family, and families we add later, on 10, 50 or 100 registered websites, billed monthly or yearly. The fonts are served by WonderFonT. There are no files to download.
Desktop and Web are separate licenses. Owning one never includes the other.
You may use the fonts in logos, commercial work, products you sell and client projects.
You may not share, resell or give away the font files, or let anyone outside your business use them.
Work you finished while licensed stays licensed.

2. Definitions

Font Software means the font files we deliver or serve to you (for example OTF, TTF, WOFF and WOFF2 files), in any version, together with any embedded data, documentation and updates we provide. Font Software is software, not a typeface design.
Family means all the styles, weights and variants we publish under one family name, including weights and styles we add to that family later. A new family name is a new Family.
Licensee or you means the person or the legal entity that holds the license. When a license is bought for a Workspace, the Licensee is the owner of that Workspace, or the company that owner represents.
Licensee's Organization means the Licensee and, when the Licensee is a company or another legal entity, its employees. Contractors and freelancers belong to it only while they work on the Licensee's own projects. It never includes other companies (including parent, sister or affiliated companies), Clients, or the public.
Workspace means the account space on WonderFonT that holds your licenses, team members, sites and billing.
Desktop License means a one-time purchase of a license to one Family for desktop use, as described in section 3.1.
Web License means a one-time purchase of a license to one Family for Hosted Web Fonts on 1, 5 or 25 Licensed Sites, as described in section 3.2.
Web Library Subscription means a paid subscription to every published Family for Hosted Web Fonts on 10, 50 or 100 Licensed Sites, as described in section 3.3.
Licensed Site means one website registered to a Web License or a Web Library Subscription in your Workspace. A site is one hostname group: example.com and www.example.com count as one site, and paths such as example.com/shop are part of the same site. Every other subdomain or hostname counts as its own site, including staging, preview and blog subdomains (for example staging.example.com or blog.example.com). Wildcard hostnames are not accepted.
Hosted Web Fonts means Font Software we serve from our servers to a Licensed Site through the embed code shown in your Workspace.
Client means a third party for whom you create work.
Finished Work means a fixed result that does not let anyone extract the font or type new text with it, such as an image, a printed item, a PDF, a video or a product package.

3. The licenses

3.1 Desktop License

A Desktop License licenses one Family, including weights and styles later added to that same Family, for a one-time payment and with no end date.

It includes the desktop installation files of that Family.
Unlimited users within the Licensee's Organization may install the Font Software on the computers they use for the Licensee's work, and use it there. Unlimited users means the people of the Licensee's Organization only, never the public or another company.
It allows client work as described in section 6.
It does not include any web use of the Font Software: no web font embedding, no self-hosting, and no use in a hosted service, such as a server or application that renders text with the font for other people.
A finished image or logo made with the font and placed on a website is Finished Work and needs no web license. Live text rendered with the font on a website needs a Web License or a Web Library Subscription.

3.2 Web License

A Web License licenses one Family, including weights and styles later added to that same Family, for a one-time payment and with no end date, on 1, 5 or 25 Licensed Sites, as bought.

The fonts are delivered only as Hosted Web Fonts, through WonderFonT.
It includes no desktop files and no self-hosted files. You may not download, extract, save, convert or host the files we serve, or use them in any other way than through our embed code.
You may upgrade a Web License from 1 to 5 or 25 Licensed Sites, or from 5 to 25, by paying the difference shown at checkout between the current price of the larger size and what you have already paid toward that Web License.
Hosted use depends on the WonderFonT service. A Web License has no end date, but it works through our hosting service. If we ever stop the hosting service, we will give you at least 180 days' notice and provide self-host files of the Family for the Licensed Sites registered to your Web License. From then on you may self-host those files only on those Licensed Sites, under section 7.3, and the rest of this License continues to apply.

3.3 Web Library Subscription

A Web Library Subscription licenses every Family published on WonderFonT, including Families published during the subscription, for as long as the subscription is paid.

It covers 10, 50 or 100 Licensed Sites, as bought, billed monthly or yearly at the price shown at checkout.
The fonts are delivered only as Hosted Web Fonts, through WonderFonT. It includes no desktop files and no self-hosted files.
One Licensed Site uses one slot, whatever the number of Families it uses.
When the subscription ends, the rules in section 8.2 apply, including a 14-day grace period for Hosted Web Fonts.

3.4 Separate licenses

Desktop and Web are separate licenses. Owning a Desktop License never includes web use, and owning a Web License or a Web Library Subscription never includes desktop use or desktop files. The allowances of separate licenses are never pooled: sites registered to one license do not count toward, or add to, another license.

A license stays valid if an unrelated license or subscription ends. A Web Library Subscription ending never reduces a Desktop License or a Web License.

3.5 Licenses bought under version 1

Licenses bought under version 1 of this License (the Personal, Studio and Agency licenses) keep the rights they were sold with and stay governed by version 1, with one change in your favor: the limit on Authorized Users no longer applies, and everyone in the Licensee's Organization may use them. Nothing else in version 1 is reduced.

3.6 More than the largest size

If you need more than the largest size of a license, contact us for a custom quote. Rights beyond your license exist only once we have confirmed them in writing and you have paid for them.

4. What you may do

Within your license and while it is valid, you may:

Desktop use. With a Desktop License, install the Font Software on computers used by the Licensee's Organization and use it to create text, graphics, layouts, documents and other designs.
Commercial use. Use the fonts in commercial work, advertising, marketing, packaging, merchandise and products you sell, with no royalty to us and no cap on print runs or units.
Logos and trademarks. Use the fonts to design logos, wordmarks and brand identities, and register those designs as trademarks. Your rights in the logo artwork are yours. You do not get any right in the Font Software itself.
Web use. With a Web License or a Web Library Subscription, use the fonts on your Licensed Sites through our Hosted Web Fonts. There is no pageview cap for normal use.
Finished Work. Make and distribute Finished Work (images, printed matter, video, broadcast, social posts and PDFs) without limit. You may embed the fonts in a PDF or similar document only as a subset and only with editing of the embedded text disabled, so that a reader cannot extract the font or edit text with it.
Client work. Create work for Clients as described in section 6.
Backups. Keep a reasonable number of backup copies of the desktop files, stored securely and used only to restore your own licensed installation.
Format conversion for your own desktop use. Convert or subset the desktop files only for your own use under your Desktop License (for example, to embed a protected subset in a PDF), keeping our copyright and license notices. Converting them into web fonts for a website is not allowed.

5. What you may not do

Unless we agree in writing, you may not:

Share, lend, rent, sell, sublicense, give away or otherwise distribute the Font Software, or make it available to anyone outside the Licensee's Organization.
Upload the Font Software to a place where people outside the Licensee's Organization can download or access it, including public repositories, shared drives, file-sharing sites, font managers that sync to other people and design tools that expose the font file to other accounts.
Use the fonts on more Licensed Sites than your license allows, or for a kind of use your license does not include (web use under a Desktop License, or desktop use under a Web License or a Web Library Subscription).
Embed desktop files in a website, self-host them, or serve them from any server.
Download, extract, save or host the files served as Hosted Web Fonts, or use them outside our embed code.
Put the Font Software inside an app, game, software product, e-book file (such as EPUB) that embeds the font, website template, theme, plugin or any product that is itself distributed to others, whether mobile, desktop, web or embedded device. This needs a separate app or embedding license from us.
Offer the fonts as part of a product or service that lets end users type or create their own text with them, such as a template editor, a print-on-demand customizer, a website builder, a generator, or a platform for creating designs (for example, "type your name on a mug"). This needs a separate license from us.
Modify, adapt, translate, reverse engineer, decompile or disassemble the Font Software, or create a derivative font from it, except for the format conversion and subsetting allowed in section 4. Editing individual letter shapes as artwork inside a finished logo is allowed; creating a new or modified font file is not.
Use the Font Software, its outlines, glyphs, metrics, kerning data or rendered output to train, fine-tune, benchmark or build any machine learning or artificial intelligence system, dataset or model, or to create a font or type generator.
Sell products whose main value is the letters of the font themselves, such as alphabet sticker sets, stencils, letter kits, rubber stamps or fonts of any kind. Products that carry your own words, names or designs are fine.
Remove or change the copyright notices, the embedded license information or the font names in the Font Software.
Use the WonderFonT name, the family names or our marks to name your own fonts or to suggest that we endorse you.
Get around, disable or weaken any protection we use to restrict web font delivery to Licensed Sites.
Use the fonts in any unlawful way or to create unlawful material.

6. Client work, contractors and agencies

Finished Work for Clients is allowed without limit. You may hand a Client Finished Work, including a logo file converted to outlines.
Editable files. You may give a Client or a printer editable files (such as a layout or a PDF) that use the fonts, but never the Font Software itself. If the Client or anyone else needs to edit the text or keep working with the fonts, they need their own license.
Websites for Clients. A website you build for a Client may use the fonts as one of your Licensed Sites for as long as it is registered in your Workspace under a valid Web License or Web Library Subscription. When the site passes to the Client for good, the Client needs its own license. WonderFonT offers a site transfer that moves the site to the Client's Workspace; the Client must hold a license with free capacity to accept it.
Contractors and freelancers working for you may use the Font Software only as part of the Licensee's Organization, only for your projects, and must delete it when the work ends. You are responsible for their compliance with this License.
Buying for a Client. You may buy a license on behalf of a Client in the Client's name, with the Client as Licensee. You may administer it for them.

7. Web fonts

7.1 Hosted Web Fonts

Hosted Web Fonts are delivered only to Licensed Sites registered in your Workspace. You must use the embed code we give you and must not copy the font files served by it. Web fonts may not be used in email campaigns, apps, ads served by third parties or on sites that are not Licensed Sites.

7.2 Replacing a site

A Licensed Site may be replaced by another hostname in your Workspace, and the new hostname keeps the slot. The old site stops being licensed when the new one takes its place.

7.3 Self-hosted files

Self-hosted web font files exist only for licenses bought under version 1 and in the end-of-service case in section 3.2. Where you hold them, you may place them only on the Licensed Sites they were provided for, and you must protect them from easy download by visitors of other websites. At a minimum, serve them only to your Licensed Site (for example with cross-origin restrictions) and do not link to them publicly.

8. Duration, subscriptions ending and your finished work

8.1 Desktop Licenses and Web Licenses

A Desktop License and a Web License do not expire. They end only if they are refunded, charged back, or terminated under section 12. Hosted delivery under a Web License follows section 3.2.

8.2 Web Library Subscriptions

While a Web Library Subscription is paid, your Licensed Sites may use every published Family through Hosted Web Fonts.

When the subscription ends (because you cancelled it or a payment failed and was not recovered), Hosted Web Fonts keep working on your Licensed Sites for a grace period of 14 days after the paid period ends, so you have time to renew or switch. After that, our servers stop delivering the fonts and your sites fall back to the fonts named in your own CSS.

8.3 Finished Work stays licensed

Anything you completed and published or delivered while your license was valid, such as logos, printed matter, images, videos, PDFs and products already made, may keep being used and distributed as it is, without end. Reprinting or reproducing that same Finished Work without changes is allowed. Editing it, or making new work with the fonts, needs a valid license.

9. Upgrades and changes

A Web License may be upgraded to more Licensed Sites as described in section 3.2. Once the upgrade is paid, the larger size replaces the smaller one.
A Web Library Subscription may move to more Licensed Sites or to yearly billing, or to fewer sites or monthly billing at the next renewal, as described in the Terms of Service.
A Desktop License cannot be turned into a Web License, or the reverse, except for the wrong-product exchange in our Refund Policy.

10. Transfer

You may not transfer a license, except that:

a Workspace owner may hand over ownership of the Workspace, with its licenses, to another person or company within the same organization, or to the buyer of your business, if the new owner accepts this License and you keep no copies of the Font Software; and
a Licensed Site with Hosted Web Fonts may be moved to a Client's Workspace through the site transfer in section 6.

Any other attempt to transfer a license is void.

11. Ownership

The Font Software is licensed, not sold. Forest Techno and its licensors own the Font Software and all intellectual property rights in it, including copyrights, and the names of the Families. You get only the rights this License expressly grants. We may improve or change the Font Software; updates we release to a Family you hold are covered by the same license.

12. Termination

This License ends automatically if you break it and do not fix the breach within 14 days after we notify you, or immediately if the breach cannot be fixed (for example, public distribution of the Font Software). A license also ends if its payment is refunded or reversed. When a license ends you must stop using the Font Software under it for new work, delete all copies, and remove it from your sites. Finished Work made lawfully before termination for a reason other than your breach stays licensed as described in section 8.3.

13. Compliance

If we have a reasonable reason to believe that the Font Software is being used beyond your license, we may ask you in writing to confirm who uses it, on how many computers and on which sites. You agree to answer truthfully within 30 days. If your use exceeds your license, you agree to buy the license that covers your actual use, at our then current prices. We will not ask more than once in any 12 months without a specific reason.

14. Warranty and liability

We warrant that the Font Software, as delivered, will perform substantially as described on the product page for 30 days after you first receive it. If it does not, tell us within that period and we will, at our choice, fix or replace it, or refund what you paid for that Font Software. This is your only remedy under this warranty.

EXCEPT AS STATED ABOVE, AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE FONT SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, LANGUAGE COVERAGE OR COMPATIBILITY WITH ANY SOFTWARE, DEVICE OR BROWSER. OUR TOTAL LIABILITY UNDER THIS LICENSE, AND THE LIMITS ON INDIRECT AND CONSEQUENTIAL DAMAGES, ARE AS SET OUT IN SECTIONS 14 AND 15 OF THE TERMS OF SERVICE.

Language coverage, weights, styles and features are those listed for each Family. The language of our website does not mean that a font supports that language.

15. Acceptance and versions of this License

Every version of this License is published at its own address, for example version 2 and version 1. We never change a published version.
When you buy a license, you accept the current version by clicking to pay under the notice that names it. For a Desktop License, you also check a box asking for the license to start at once. We record the version, the date and a fingerprint of the exact text you accepted. Your receipt and your license certificate link to that version.
A Desktop License or a Web License stays governed by the version you accepted when you bought it, unless you accept a newer one. An upgrade of a Web License accepted under a newer version brings that Web License under the newer version.
A Web Library Subscription renews under the version you accepted, with no new acceptance. If we publish a new version, we will email the Workspace owner at least 30 days before it applies to your subscription. It applies from your first renewal after those 30 days, unless you cancel before that renewal.

16. General

This License is governed by the governing law and dispute terms set out in the Terms of Service. If a provision of this License is found unenforceable, the rest of it stays in force. Our failure to enforce a provision is not a waiver.
